01 1. Acceptance of the Terms

These Terms constitute a legally binding agreement between you (hereinafter "you" or the "user") and Gizem Acar, who provides the Service. By downloading the CalSensei application, creating an account, or using the Service in any manner, you accept these Terms and our Privacy Policy, which is incorporated by reference into these Terms.

If you do not accept these Terms, you must not use the application, create an account, or access the Service. If you are using the Service on behalf of a person, company, or other legal entity, you represent and warrant that you are authorized to bind that person or organization to these Terms.

02 2. Eligibility and Age Requirement

In order to use the Service, you must have reached the minimum age applicable in your country of residence and have the legal capacity to enter into a binding contract.

CalSensei is not intended for children under the age of 13 (16 in the European Union), and we do not knowingly collect personal data from such children. If you are under 18, you may use the Service only under the supervision and with the consent of your parent or legal guardian. If we identify an account that we believe belongs to a child under the age of 13 (16 in the EU), we may delete that account and its data.

03 3. Description of the Service

CalSensei is an AI-powered calorie and nutrition tracking application that analyzes your meal photos to produce estimated calorie and macronutrient values. When you take a photo of a meal, the photo is uploaded to the cloud for analysis and processed by an AI image/language processing pipeline to generate estimates of calories as well as protein, carbohydrates, fat, fiber, and sugar.

The Service may also provide recipe suggestions and recipe texts, daily calorie and macro goals calculated from the profile information you provide (height, weight, age, gender, nutrition goals), and a discovery feed composed of food images. Your meal photos and the nutrition data derived from them may be stored so that you can view your history.

We reserve the right to modify, suspend, or discontinue the Service and the features we offer at any time, with or without prior notice.

04 4. Health and Nutrition Disclaimer (IMPORTANT)

PLEASE READ THIS SECTION CAREFULLY. CalSensei provides automated ESTIMATES for general informational purposes only. All values it provides are estimates and are NOT medical, nutritional, dietetic, or any other kind of professional advice. CalSensei is not a medical device.

AI-based estimates may be inaccurate, incomplete, or misleading. The calorie and macronutrient values produced from meal photos are not precise measurement results and may deviate significantly from the actual values. For this reason, you should not rely on these values for medical or health-related decisions.

The Service cannot be used for the diagnosis, treatment, cure, prevention, or management of any medical condition or eating disorder (for example, anorexia, bulimia, or similar conditions). CalSensei is not designed for these purposes and is not appropriate to be used for them.

Before making any decision regarding nutrition, diet, exercise, or your health, you must always consult a qualified health professional (a physician, dietitian, or relevant specialist). If you have a medical condition, or are pregnant or breastfeeding, or have special nutritional needs, it is especially important that you consult your health professional before using the Service.

Your use of the Service is entirely at your own risk. We are not responsible for any actions you take or refrain from taking based on the estimates or information you obtain from the Service.

05 5. Account and User Responsibilities

To use certain features of the Service, you may need to create an account. When creating an account, you agree to provide accurate, current, and complete information and to keep this information up to date.

You are responsible for protecting the confidentiality of your account credentials and for all activities that occur through your account. If you become aware of any unauthorized use of your account, you must notify us immediately at support@calsensei.com.

You agree to use the Service only for purposes that comply with applicable laws and are permitted under these Terms. You are responsible for the accuracy of the data you provide, including your profile information (such as height, weight, age, gender, and nutrition goals); if this data is inaccurate, the calculated goals and estimates will also be inaccurate.

06 6. Application License and Apple EULA

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install the CalSensei application on iOS devices that you own or control and to use it for personal, non-commercial purposes.

This license is not a transfer of ownership. You may not copy, modify, distribute, sell, rent, reverse engineer, decompile into source code, or create derivative works from the application or any part of it (except as expressly permitted by applicable law).

Because the CalSensei application is distributed through the Apple App Store, in addition to these Terms, Apple's standard Licensed Application End User License Agreement (EULA) also applies to your use of the application. In the event of any conflict between these Terms and the Apple EULA, the minimum provisions of the Apple EULA shall apply with respect to the application acquired from the App Store. Under the Apple EULA, Apple is a third-party beneficiary of the application and has the right to enforce these Terms against you.

07 7. Subscriptions, Free Trial, Auto-Renewal, and Cancellation

Certain premium features of the Service ("CalSensei Pro") may require a paid subscription. CalSensei Pro is sold through Apple In-App Purchase, and subscription management is carried out via RevenueCat. Subscriptions may be offered as weekly, monthly, and annual plans and may include a free trial period.

Where a free trial period is offered, if you do not cancel before the trial period ends, the subscription will automatically convert to a paid subscription and the fee for the plan you selected will be charged. Any unused portion of the free trial is forfeited when you switch to a paid subscription.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period, and the fee associated with your account is charged at each renewal period. You can manage your subscription or turn off auto-renewal at any time from your App Store account settings; cancellation takes effect at the end of the current billing period.

08 8. Billing and Refunds

Subscription payments are processed by Apple through your App Store account. Your payment information is managed by Apple; we do not have direct access to this information. Prices, taxes, and currency are as displayed in the App Store and may be changed with prior notice.

Refunds are handled by Apple in accordance with Apple's App Store policies and rules in effect at the time. Refund requests must be directed to Apple (the App Store); we are not authorized to process refunds. Your rights under applicable consumer legislation are reserved.

09 9. Acceptable Use and Prohibited Conduct

When using the Service, you agree to refrain from the following conduct:

• Using the Service for any unlawful purpose or in a manner contrary to applicable legislation.
• Infringing the rights of another person or organization (including intellectual property, privacy, or personality rights).
• Reverse engineering or decompiling the application or our infrastructure, gaining unauthorized access, abusing it with automated tools (bots, scrapers), or overloading it.
• Attempting to circumvent the Service's security measures, distributing malware, or hindering or disrupting the operation of the Service.
• Using inaccurate, misleading, or another person's credentials, or impersonating another user.
• Reselling, renting, or commercially using the Service without our prior written permission.
• Uploading content that is unlawful, harassing, obscene, or that infringes the rights of third parties.

10 10. Intellectual Property Rights

The Service and its content, including but not limited to the software, design, interface, logos, trademarks, texts, recipes, discovery feed content, and outputs generated by artificial intelligence, belong to us or our licensors and are protected under intellectual property legislation and international treaties.

Except for the limited usage license expressly granted to you in these Terms, no right, title, or interest in the Service is transferred to you. The name "CalSensei" and the related logos are our trademarks and may not be used without our prior written permission.

11 11. User Content and Meal Photos

The meal photos you upload to the Service and the other content you provide ("User Content") belong to you. You represent that you have all the necessary rights and permissions over the content you upload.

By providing your User Content to the Service, you grant us a worldwide, royalty-free, limited license to process, upload to the cloud, and store the content for the purpose of providing the Service and its features to you, to have it analyzed by our AI inference provider, to generate nutrition estimates and related outputs from it, and to retain it so that you can view your history. This license is used solely for the purpose of providing and operating the Service and within the framework of these Terms and our Privacy Policy.

Details regarding the processing and storage of your meal photos are explained in our Privacy Policy. When you request the deletion of your data, the relevant User Content is deleted, subject to our applicable legal obligations.

12 12. Third-Party Services

We rely on various third-party service providers to deliver the Service. These include cloud hosting and storage providers, an AI inference provider that analyzes meal photos and generates nutrition estimates and recipe texts, subscription management (RevenueCat) and Apple In-App Purchase, analytics and crash reporting services, and push notification services. Subscription payments are processed by Apple.

Your use of these third-party services may be subject to the respective providers' own terms and privacy policies. We have no control over the availability, accuracy, or performance of third-party services, and we are not responsible for situations arising from these services, to the extent permitted by applicable law. Detailed information about data sharing and transfers regarding third parties is provided in our Privacy Policy.

13 13. Disclaimer of Warranties ("As Is")

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without any express or implied warranty. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not warrant that the calorie, macronutrient, and other estimates produced by the Service will be accurate, current, complete, or reliable. The Health and Nutrition Disclaimer set out in Section 4 is an integral part of this disclaimer of warranties. The decision to use the Service and the risk associated with the results of such use rest entirely with you.

14 14. Limitation of Liability

To the maximum extent permitted by applicable law, we and our affiliates will not be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits, loss of data, health-related consequences, or loss of reputation) arising from or related to your use of or inability to use the Service.

To the maximum extent permitted by applicable law, our total liability for all claims arising from these Terms or your use of the Service will not exceed the amount, if any, you actually paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the disclaimer of certain warranties or the limitation of liability for certain damages. In such cases, the above limitations apply to you to the extent permitted by applicable law, and your non-waivable statutory rights as a consumer are reserved.

15 15. Indemnity

You agree to defend, indemnify, and hold harmless us and our affiliates from and against any and all claims, lawsuits, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your breach of these Terms, the User Content you provide, or your violation of applicable laws or the rights of third parties.

16 16. Termination

You may stop using the Service at any time and request the deletion of your account at support@calsensei.com.

If you breach these Terms, act unlawfully, or endanger the security of the Service or other users, we may suspend or terminate your access to your account and your use of the Service, with or without prior notice. Upon termination, the provisions of these Terms that by their nature should remain in effect (such as intellectual property, disclaimer of warranties, limitation of liability, indemnity, and governing law) will continue to remain in effect.

17 17. Changes to the Service and the Terms

We may update the Service and these Terms from time to time. When we make significant changes, we will reasonably notify you by publishing an updated version on this page and changing the "Last updated" date; where appropriate, we may also provide notice within the application.

Your continued use of the Service after the changes take effect means that you accept the updated Terms. If you do not accept the updated Terms, you must stop using the Service.

18 18. Protection of Personal Data and Your Rights

We process your personal data in accordance with applicable legislation, in particular Law No. 6698 on the Protection of Personal Data (KVKK) in Türkiye and the General Data Protection Regulation (GDPR) in the European Union. The data processed may include meal photos, nutrition and meal records, the profile data you provide (height, weight, age, gender, nutrition goals), account identifiers, device information, and usage analytics. Details are explained in our Privacy Policy.

Under applicable legislation, you may have rights such as accessing your personal data, correcting it, requesting its deletion, objecting to its processing, data portability, and withdrawing the explicit consent you have given. To exercise these rights, you may contact us at support@calsensei.com.

Your data is retained for as long as your account is active and to the extent necessary to provide the Service and fulfill our legal obligations; upon your request, it is deleted within the framework of applicable legislation. Your data may be processed outside of Türkiye or the European Economic Area by our cloud and AI providers, provided that appropriate safeguards (for example, standard contractual clauses) are in place. We take reasonable technical and administrative measures to protect your personal data; however, no method of transmission over the internet or electronic storage is one hundred percent secure, and absolute security cannot be guaranteed.

19 19. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict-of-laws rules.

The courts and enforcement offices of the Republic of Türkiye have jurisdiction over the resolution of disputes arising from or related to these Terms. As a consumer, your mandatory rights granted to you by the applicable consumer legislation of your place of residence and your right to apply to the competent consumer arbitration committees and consumer courts are reserved.
